General meetings are held on a monthly basis (except December and January). Regularly
scheduled general meetings are on the second Wednesday of each month. The annual meeting
of the association is held in January of each year. For more information, check the website at

memo and/or questions concerning an investigation that could possibly lead to punitive action. If
ordered to do so, ask to have it recorded and read the following: Non-waiver statement
“I have been refused the right to have a representative of my
choice. I understand that I am being ordered to make a report or
answer questions and that, if I do not comply with the order, I may
be disciplined for insubordination.
Therefore, I have no alternative but to abide by the order. However,
by so doing, I do not waive my constitutional rights to remain
silent under the 5th and 14th amendments to the United States

PRESIDENT’S CORNER
Looking Back Over The Year

A
s we make
our way
through
the month of July, I
look back on where
we were a year ago.
In the July, 2018
President’s Mes-
sage, I talked about
improving our com-
munication with our Members. At the
beginning of 2019, RSA hired a Media
Relations Manager, Kathy Delgado. Kathy
was tasked with improving RSA’s digital
footprint and creating a new RSA web-
site. Kathy hit the ground running and
immediately increased our presence on
the three main Social Media platforms.
Kathy also began working with New Eq-
uity Productions (NEP) to create a new
RSA website.
After months of work on the new
website, it went live over the Fourth of
July weekend. If you have not visited
the website, please do so, and share your
thoughts and or suggestions with Kathy
at [email protected]. Like most new
projects, the new site is a work in progress
and we plan to continue improving it to
better communicate with our Members.
I’d also like to say “thank you,” to the
Members who have answered the call by
stepping up and donating each pay period
to the Riverside County Deputy Sheriff
Relief Foundation. Over the last couple
of months, we have seen an increase in
payroll contributions from our Members.
This is great to see and allows us to help
our Members even more, but our job as
Members is not done! We need each and
every one of our Members to ultimately
donate, so that we can be there if needed
in every Members time of need.
Lastly, I want to thank all of our Mem-
bers who have continued to be the back
bone of this County through these times
of extremely short staffing and horribly
imposed terms and conditions. Please
stay the course and we will continue to
do our part working towards improving
the terms and conditions.
As always, stay safe out there and
help ensure your partners go home safe.

Scholarship Programs
The Riverside Sheriffs’ Association established a scholarship program to assist our
members, members’ children, and student residents of Riverside County.
Each year, RSA awards scholarships to help recipients reach their higher education goals.

O
ur scholarship programs are administered
by Scholarship America, the nation’s larg-
est designer and manager of scholarship
and tuition reimbursement programs for corpora-
tions, foundations, associations, and individuals.
A total of four member scholarships were
granted this year. The recipients will each receive a
$5,000 award. The Member Scholarship Program
awards are for undergraduate and graduate study.
Also, eight student scholarships were granted to
dependents of RSA members and/or Riverside
County residents. Under the Student Scholarship
Program, we have the Riverside Sheriffs’ As-
sociation Memorial Scholarship and the Riverside
County Deputy Sheriff Relief Foundation Scholar-
ship. Recipients of this scholarship will receive
an award of $2,500 if attending an accredited
four-year college or university to obtain a bachelor
degree or $1,000 if attending an accredited two-
year college, vocational-technical, or trade school
to obtain an associate degree or certificate.
Deputy Alan Avila, a recipient of the member
scholarship, is working towards his Master’s Degree
in Criminal Justice. Deputy Ned Hyduke is another
recipient of the member scholarship. To Deputy
Hyduke, this scholarship is motivation to continue
his education and finish his program to obtain his
Bachelor’s Degree in Applied Arts & Sciences.
Deputy Hyduke left us with some advice for
other RSA members thinking about pursuing
their higher education, he said, “To not be
intimidated by the process, it can be a long road,
but it is worth it.”
Deputy Percival Saldevar is another recipient
of the member scholarship. To Deputy Saldevar,
this scholarship is one of the best things RSA offers
as it is a great help to those trying to pursue their
higher education. He is working on obtaining his

Deputy Saldevar’s advice to other RSA
members looking to pursue higher education is,
“Check out RSA and learn about the scholar-
ship programs,” he said.
Two of the recipients of the student
scholarships are Noah and Robyn Heath. Noah
is a student at UC Santa Cruz and is studying
computer science. Robyn is a senior at Northern
Arizona University and is studying mathemat-
ics. Robyn has been awarded this award for the
third time. When asked what this scholarship
means to her, she said, “This scholarship means
that all of the hard work that I put into my
education is worth it, and ultimately that I am
believed in. Going into the teaching field some-
times feels more challenging than rewarding,
but moments like this help me realize that other
people believe in me and my career path.”
RSA is happy to be able to give back not
only to our members but to their families, as
well as to the communities we serve. For more
than ten years our scholarship programs have
been assisting students and we couldn’t be more
pleased with the positive impact these programs
have on our communities.

SUMMER SAFETY EXTRAVAGANZA

T
his year was our 9th Annual Summer Safety
Extravaganza. The focus of the event is to bring
awareness to child abuse prevention and heat/
water safety. Our law enforcement and community agen-
cies are committed to keeping the children in our com-
munity safe.
We are very fortunate in Blythe in that we have
amazing collaboration and our agencies work together in
our goal to provide services and address the needs of the
public. This free event gives our community partners the
opportunity to interact with families and provide informa-
tion on the services they provide while providing a family
day of fun and laughs to start the summer.
The event featured twelve different water slides and
nearly 600 children were in attendance.
We are very thankful to our sponsors, Riverside Sher-
iffs’ Association, HOPE Collaborative, Blythe Energy,
Rebel BBQ, and Blythe PAL as without them, we could
not put this event on year after year.

Robert Allen Foley
Robert Allen Foley passed away while on vacation in Peru on
7/4/19. Rob left this world doing what he loved and that was
living life to the fullest, not letting a moment go to waste.
R
ob graduated from the Sheriff’s academy on 10/30/08, but he wore many
other hats in his short life of 47 years. Rob was a skydiver, a pilot, an artist,
played an acoustic guitar and he rocked an electric. Rob was a jokester, a
comedian, should have been a race car driver, an amazing cook, classic car collector,
dog lover and the most amazing Son, Brother, Uncle, and Friend.
Rob had so many amazing adventures and awesome stories to tell with them.
Rob traveled to many countries and tasted many foods and beverages to please his
intrinsic palette. Every trip Rob took, he made sure to bring back a souvenir for
everyone. Rob loved his friends and family, he would help anyone in need at any
moment, he knew no strangers.
Of course we are biased, being his family, but he truly was an amazing guy and
extremely humble. There have been so many people sharing how Rob helped them
in a difficult time and he never told us these stories. We have been so grateful for all
of the love and support from his work family, you are all very special people. This is
a very difficult time, but we find some peace in hearing all the stories and pictures
that have been shared about our Rob.
IN LOVING MEMORY
At this time, we still do not have our
Rob back home from Peru, but as
of now, the date is set for 7/13/19.
We are unable to plan a service
until we can conrm this is the date
we can be reunited with him. We
will continue to provide updates.
I would also like to give a special
thanks to RSA for reaching out and
helping us. There have been so
many things to get in place and
they have been a blessing.

force! A force
for good, a
force for God! A
force to be reck-
oned with! Little do
we know of the pain
and suffering of our earnest and resolute
forebearers. They were men and women
who were virtual slaves to the crown.
That is what the English served. They
served with great dedication. They served
under the deepest kind of degradation.
Royalty was paramount, nobles were
next, merchants were near the bottom of
the barrel. Everyone else were virtually
slaves. They lived in hovels on streets
running with human waste, with garbage,
with rats and roaches. They were like two-
legged animals. There was no medicine.
There was no mercy. They were expend-
able as horse dung on the streets. An old
man or woman at age 35 – 40 was a gin
alcoholic without teeth and rotten pus
killed mouths in great pain every moment.
A 1500 nursery rhyme was “peas por-
ridge hot, peas porridge cold, peas porridge
in the pot, nine days old.” This was a
standard diet. No meat, no milk, no fruit.
Just flat bread and porridge. Someone did
not like the economics of the crown and
decided they needed to GET AWAY. They
went to the free lands or the American
coast. Some aggressive acquisitive decided
to take a tax-free cut of the heavens! It
worked! The inordinate and confiscatory
taxation gave them great incentive to
build even more capital. That worked too!
Everybody who wasn’t drunk could earn!
Wow! What a rush! Men and women
found the concept of prosperity attractive!
They exulted over the fact they could buy
good food, property, and human needs for
family and friends. They did not have to
endure daily bondage. It was a raging fire
in the bellies of a long-deprived segment
of society. Suddenly they felt “rich”! The
concept spread like a forest fire. Money
meant freedom. Freedom meant liberty.
Liberty spawned abundance, and no king
took everything you had.
Children became healthier as malnutri-
tion was overcome. Those who never had
any excess of funds, found profits. That
gave them a sense of ownership and they
exchanged ideas with all of the industrious
newbies. They organized on a free scale.
They helped others to acquire profits
and a new concept was born. ANYONE
COULD BE A CAPITALIST! Freedom!
Freedom! Freedom! Let it rage as more
accepted it. With that scope of abundance,
the people became proud. They became
protective and then PATRIOTIC. Patri-
otic and a burgeoning population of free-
dom activated zealots jealously scrambling
to establish a NEW COUNTRY! Pride in
ownership, pride in possessions and pride
in being beholden to no pompous elitist
king who “stole” everything you earned
and made you a slave!
That pride, that opportunity, that
concept and their individual PRIDE was a
new feeling in the lush lands of America.
Industry flourished and then one day a
group of men gathered in a tavern and
stated “We must have a Declaration of
Independence!” What was so hard come
by men of vision cannot, shall not, will
not be consigned to a destiny of failure.
Welcome to the U.S.A.!!! Never give in
to slavery again! Love U.S.[A.] or Leave
U.S.[A.]! Let the force be with you!
Let us give thanks for the men and
women who suffered so much to give us
this wonderful County. We honor our
dead so that we may educate the living.
God bless them all. Amen.

ach year, the legislature adjourns for its
annual month long summer recess.
Although the members of the
legislature will not be in Sacramento for a
month, we continue to meet with legislative
staff to prepare arguments, amendments
and develop timing strategies for the most
important bills in anticipation of the return of the lawmakers in
mid-August.
Here are some of the bills we’ve been working on that will be
passed or defeated in the four remaining weeks of the legislative
session that ends on September 15:

Political Update
It seems like we just finished the 2018 elections, but the 2020
campaigns are already beginning to take shape and will be heating
up over the coming months. The 2020 turn-out models for the
March primary and November general elections are expecting a
continuation of the higher-than-average voting percentages in
California and across the country.
Presidential election years tend to generate higher levels of voter
participation due to increased media coverage and political interest
as both national parties increase their spending to secure the
nominations and victory of their endorsed candidates. As a result,
our state will play a significant role in shaping the composition of
the next Congress. Relatedly, our local legislative, county, and city
government elected seats will benefit from, or suffer the conse-
quences of the unknown effects of a significantly higher number of
votes being cast.
The presidential and statewide primaries will be held in March
2020 instead of the traditional month of June. This change shortens
the primary campaign season by three months, requiring us to
expedite our efforts to ensure that the interests of the RSA are
protected and advanced.
The most important 2020 races for the RSA are expected to be
the two Riverside County Board of Supervisor seats that will be up
for election.
If no candidate in either district fails to receive 50% +1, a run-
off election will be held and coincide with the national presidential
election in November 2020.

POLITICS
Riverside County District 1 is currently
represented by Supervisor Kevin Jeffries
and District 3 is currently represented by
Supervisor Chuck Washington.
Like all incumbents and candidates,
these two Supervisors have both supported
and opposed the positions advocated by
your association. It will be up to your RSA
political action committee and ultimately
your Board of Directors to weigh the
positives and negatives of the incumbents
and their challengers in order to reach a
decision on endorsements and potential
financial support.
Many contests will be held for mayor,
city council, and school board seats
throughout the county and we will pay
close attention as these races develop,
especially those in contract cities. Many of
these locally-elected officials continue on
to serve as county supervisors, state legisla-
tors, and as members of Congress. Getting
to know and understand these elected
officials early on provides the RSA with
an opportunity to make better-informed
decisions as they begin to move up the
political ladder.
We expect the background research
to be completed later this fall in order to
provide the RSA political action commit-
tee with the information needed to assist
them during their internal discussions and
the candidate endorsement interviews.
Over the last few years, your association
has stepped up its efforts to expand its po-
litical participation in a professional effort
that focuses on supporting candidates who
support public safety and the jobs that the
members of the RSA perform 24/7. This
forms the basis of the political decisions
your PAC and Board make. The RSA has
not been politically successful by accident.
Years of laying groundwork, compiling
research, and developing relationships is
what has made us so successful.
We will continue to work diligently to
ensure our political goals are met in 2020
and beyond.

U
nder civil remedy jurisdiction,
the general population has a duty
to avoid causing injuries to other
citizens. This obligation is established
relative to driving safely to prevent ve-
hicular accidents, providing a safe place
for customers to shop and employees
to work, protecting individual personal
property, and endless other situations
which potentially could result in injuries
to the public.
Within the safety community, the
general assumption is that police officers,
deputy sheriffs, Highway Patrol officers,
and firefighters face unique risks inherent
in the nature of their employment, and if
they are injured while engaging in activi-
ties which pose such risks, they have very
strong limitations regarding seeking civil
remedies against the person or persons
who caused the need for the call-out
resulting in their response. This is known
as the “firefighter rule”. This rule was
established based on the premise that
safety personnel face unique risks in the
course of their usual and customary duties
while responding to emergency situations.
The thought has been that if a limitation
was not placed upon safety personnel
responding to these emergencies, the
individuals aware of the fires, accidents
or shootings would not seek any safety
response to avoid their own civil liability.
However, there are exceptions to the
firefighter rule” - situations wherein
safety members responding to an event
may seek some civil remedies (remedies
outside the Workers’ Compensation and
retirement systems) against the person
asking for the call-out. An obvious ex-
ample where the “firefighter rule” would
not apply would be situations where an
individual driving a vehicle strikes a
safety officer and causes injury. In that
type of situation, there is no restriction
preventing the safety member from
seeking a civil remedy against the person
causing the harm. The “firefighter rule”
was against safety workers injured while
responding to critical situations.
The Court will look to determine
whether the safety officer was injured
while performing a public service duty.
There can be exceptions to the “fire-
fighter rule”, and whether it has applica-
tion to safety officers injured - whether
on or off duty - while containing and
controlling a suspect on the defendant’s
premises if the officer was injured while
performing a public service, such as auto
accidents, fires or shootings.
The Court has established that safety
responses remain the financial burden of
the government agency which employs
the safety member(s) so that people in
distress will call and seek assistance when
necessary. The Court has also reviewed
the unique benefits which safety people
have, such as benefits pursuant to Labor
Code §§4800.5 and 4850, as well as
industrial disability retirements. The
special pay and disability retirement
benefits are compensation for the hazards
which safety members face in the course
of performing their duties.
Exceptions to the “firefighter rule”
also come into play when safety workers
are present in a critical response situation
and are not aware of the special risks
which may exist. In one situation, for
instance, a chemical plant did not inform
the safety personnel responding to a fire
“there are exceptions to the ‘reghter rule’ - situations wherein safety
members responding to an event may seek some civil remedies”

that a toxic chemical was involved, and
did not provide information regarding
the possible damage which might result
from such exposure, even though the
company was privy to this information.
The Court determined that not inform-
ing the safety members of the complexity
and extent of the risks involved in
fighting this fire was a negligent and
intentional act by the employer.
Another situation which would con-
stitute an exception to the “firefighter
rule” involves scenarios where safety
members are responding to a situation
involving a suspect known to have
engaged in violent acts and who has
a weapon and has threatened to kill
safety officers, yet this information has
not been disclosed to the responding
officers. This type of situation places
liability on the person failing to make
such a disclosure.
If a safety member responding to an
emergency situation happens to be on
the scene at the time, the property owner
has the same liability to all individuals,
whether or not they are safety members.
Recently, a case of the “firefighter
rule” was raised relative to a vehicular
collision involving six drivers. Drivers
1, 2, 3, 4 and 5 all lost control of their
vehicle. The Court ultimately found that
driver 5 was subject to litigation, because
this driver failed to comply and cooper-
ate with the firefighter directive to walk
with the other drivers off the highway.
In this situation, the driver walked to
the driver’s side of the car before letting
himself be assisted toward the shoulder
of the road. This delay caused injury
when driver 6 struck the safety officers
assisting driver 5. Driver 5’s conduct was
negligent in not following the firefighter
directive for all parties to remove
themselves from the situation. The
officer being struck by the car had civil
remedies in this situation in addition to
his Workers’ Compensation rights.
Another type of situation occurs when
a police officer comes onto a property
and is injured while walking up or down
a stairway which the owner knows is
damaged and unsafe to use. In this case
again, civil remedies would be available to
the safety officer against the owner.
In conclusion, while the “firefighter
rule” applies in some situations, there
are exceptions, such as those mentioned
above - when fighting a fire poses toxic
exposures which are not made known
to the safety responders, when an officer
is sent to a residence without being
informed that the subject is known to
be armed and violent and has a hatred
towards safety people, or when an officer
is not informed of safety risks for which
a property owner is responsible. These
are examples of civil remedies available
to safety officers outside and above the
Workers’ Compensation venue, and
outside the “firefighter rule” .
